(“Mars Logistics”) undertake every effort to take any and all actions and measures for the protection and privacy of personal data pertaining to their current and potential customers, business partners, visitors, shareholders, company executives, employees, employee candidates, the employees and officers of the institutions and companies that they collaborate with and any other relevant third persons under the Law no. 6698 on Protection of Personal Data (“KVKK”). Your personal data may be processed under the capacity as the ‘Data Controller’ for the purposes specified below and by taking all technical and organizational measures under the Law no. 6698 on Protection of Personal Data.
Your personal data may be processed in accordance with the conditions specified in Articles 5 and 6, subject to the fundamental principles of the Law no. 6698 on Protection of Personal Data.
Mars Logistics may process your personal data for the purposes of the follow-up of and replying to your suggestions, requests and complaints, increasing customer satisfaction, conducting sales and after-sales support processes, conducting the contractual processes, carrying out social responsibility and civil society activities, conducting advertising, campaign, promotion and sponsorship processes, organization and events management, planning or implementation of new strategies, marketing activities, conducting supply chain management processes, carrying out logistics activities, providing information to competent persons, entities and institutions, conducting the activities for ensuring business continuity, and planning of human resources processes.
Your personal data are collected verbally, in writing or electronically through various channels considering the aforementioned purposes and the conditions and circumstances specified in the legislation.
Explicit consent is obtained in accordance with the applicable laws during the process of processing of all such data.

Personal data are collected and processed by Mars Logistics in a lawful manner and for a legitimate purpose by showing due care and diligence and stored in a safe and secure manner. Personal data are deleted, destroyed or anonymised with a suitable method in line with this Policy when the purpose of processing of such data ceases to exist or is completed.
Confidentiality: It is essential that the processes related with the processing of personal data within Mars Logistics are executed in strict confidence. In this context, Mars Logistics prevents any unauthorized access to personal data to the extent possible; takes any and all technical and organizational measures possible under its structure and conducts the related audits periodically.
Compliance with Law and the Rules of Integrity: Mars Logistics collects and processes personal data within the limits stipulated by the applicable laws and in compliance with the law and the rules of integrity.
Accuracy and Updating when required: Personal data are stored by Mars Logistics completely and accurately and updated when required. If the personal data are not accurate or up-to-date, Mars Logistics makes the necessary determinations and arrangements for correction, amendment, updating or deletion of such data.
Certainty and Transparency: Mars Logistics processes personal data for certain, clear and legitimate purposes and does not process personal data for any other purposes except for the data collection and processing purposes made transparent to the relevant data subject. The legitimacy of the purpose means that the data processed by Mars Logistics should be connected with and required for the business performed or the service provided by Mars Logistics.
Relevance, Proportionality and Consistency: Personal data processed by Mars Logistics are processed in a manner relevant, proportional and consistent with the purpose specified only; and in this context, personal data are processed subject to a reasonable limitation. No personal data shall be collected for any possible data processing purposes that may emerge in future; and personal data shall not be used, processed and transferred in any manner not suitable for the purpose of collection of such personal data.
Pursuant to minimum data principle, personal data are kept limited and proportional to the purpose of collection; and according to such purposes, any data not required are not stored.
Limited Period: If the principal purpose necessitating the processing of personal data ceases to exist and such data are no longer needed, the related personal data are deleted, destroyed or anonymised. If there are any periods stipulated in the laws for storage of data; such data shall be stored in accordance with the periods specified in the relevant legislation; and upon completion of the period specified in the laws, such data are checked by Mars Logistics at specific intervals and deleted from the systems/devices or environments that such data are physically stored in; or destroyed or anonymised.
Selection and Approval: Mars Logistics informs the data subject completely and as required in relation to the processing of personal data. If and when required, Mars Logistics takes the data subject’s consent for the relevant processing; and offers to the data subject the option to withdraw such consent or make any request in relation to their data at any time desired. Mars Logistics shall deal with the relevant data subject’s personal data in accordance with the other principles specified in this Policy after the relevant data subject withdraws their consent.
The Law no. 6698 on Protection of Personal Data (“KVKK”) has granted the data subjects that are the owners of personal data the right to make some claims in relation to the processing of their personal data in article 11 of this law. In this context, according to the Communiqué no. 30356 on Principles and Procedures regarding Application to the Data Controller; Mars Logistics Group Companies comprising Mars Lojistik Grup A.Ş., Mars Lojistik Uluslararası Taş. Dep. Dağ. Ve Tic. A.Ş., Mars Hava ve Deniz Kargo Taşımacılığı A.Ş., and Mars Sigorta Aracılık Hizmetleri Ltd. Şti. (“Mars Logistics”) are obliged to answer such requests.
Pursuant to the first paragraph of article 13 of the Law on Protection of Personal Data; it is required that the applications to be made to our company as the data controller in relation to such rights should be notified to us in writing or via the following methods as specified by the Personal Data Protection Board (the “Board”).
In case of applications delivered by hand, any person’s application is accepted upon identity verification of the relevant person. Mars Logistics employee receiving the application shall, after performing the identity check, indicate on the form the completion of the identity verification. The applications made to these channels should be sent over the relevant person’s KEP (REM) address only and no further identity verification is needed. An application with electronic signature and/or mobile signature is sent by the relevant person to Mars Logistics’ e-mail address of [kvkk@marslogistics.com]. The electronic signature on the application form sent as such shall be checked to ensure whether the file was signed with the secure electronic signature application or not and the application is accepted after identity verification. If the signature cannot be verified through secure electronic signature application or if the form has been sent with mobile signature, the relevant person shall be directed to the written channels. The application sent by the relevant person to Mars Logistics registered address via a public notary are received by Mars Logistics General Directorate Customer Relations Department. Your applications that you have sent to us shall be answered within 30 days following the date of our receipt of your request according to the nature of the request as required by the 2nd paragraph of article 13 of the Law on Protection of Personal Data. (“Mars Logistics”) in the capacity of data controller in accordance with the Law No. 6563 on the Regulation of Electronic Commerce, the Regulation on Commercial Communication and Commercial Electronic Messages and the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed up in the Fulfillment of the Obligation to Provide Information, for the purposes of sending commercial electronic messages to you and to provide information to you about the processing, storage and transfer of your personal data and to fulfill the obligation to provide information.
Name, surname, contact information and license registration information of the vehicle, by which you have previously provided the supply services to Mars Logistics, which was granted to and obtained by Mars Logistics based on your explicit consent, will be processed by us according to the legal reasons of ''it is necessary to process the personal data of the contracting parties, provided that it is directly related to the conclusion or execution of a contract", "it is mandatory to process the data for the legitimate interests of the data controller, provided that it does not damage the fundamental rights and freedoms of the data subject" and "it is mandatory for the data controller to process the data in order to fulfill its legal obligation" as regulated in the Article 5 of the Personal Data Protection Law No. 6698, for the purposes of managing business processes and contract processes, sending information about potential business partnerships via SMS, verifying the identity of the individuals conducting the transactions and the individuals on whose behalf or account these transactions are conducted, before the transactions are done by Mars Logistics or intermediated by Mars Logistics, and following up the finance, accounting and/or invoicing processes. Your personal data is collected and processed through the Mars Logistics websites, mobile applications, contact form, application form or the Mars Logistics Call Center in accordance with the laws and the rules of integrity, accurately and as updated in case of necessity, for the determined, explicit and legitimate purposes and in connection with, limited to and relevant to the purpose of processing, and kept for the periods prescribed in the relevant legislation or according to the framework described for the purpose of processing and as stipulated in the other legislations.
Pursuant to the Article 11/7 of the Regulation on Commercial Communication and Commercial Electronic Messages, the procedure for the approval and rejection of sending commercial electronic messages must be executed through the Message Management System. Due to the obligation to register for the system, your personal data will be transferred to İleti Yönetim Sistemleri A.Ş. and will be processed by registering such data in the system operated by it in order to fulfill our legal obligation. In addition, according to the Personal Data Protection Law No. 6698, we transfer your personal data, upon request, to judicial authorities, law enforcement officers, authorized institutions and organizations to fulfill our legal obligations, as well as to law offices to manage our legal processes in case of occurrence of any legal dispute, to our direct or indirect subsidiaries, business partners and suppliers, in case it is mandatory to conduct our operations, and to the program partners as Natural Persons or Private Law Legal Entities, who are jointly and severally responsible together with us for taking occupational safety measures such as protecting all types of personal data, preventing unauthorized access and preventing unlawful processing of personal data etc., and to the third parties to which Mars Logistics provides services before and after the transportation, within the scope of and only in relation with the transportation service, upon obtaining the explicit consent of the data subject, and transferred abroad only to the principal shareholder of Mars Logistics, in case it is deemed necessary in terms of the financial reporting, because the principal shareholder of Mars Logistics is located abroad.
In accordance with the Article 11 of the Personal Data Protection Law No. 6698; you, as the personal data subjects, are entitled to know whether your personal data has been processed, and to request information if your personal data has been processed, to know the purpose of processing your personal data and whether such data has been used appropriately for the intended purpose, to know the third parties to whom your personal data has been transferred domestically or abroad, to request rectification in case your personal data has been processed incompletely or inaccurately and to request provision of information to third parties, to whom personal data has been disclosed, in relation with such rectification, to request the deletion or disposal of personal data after the reasons for processing of such personal data have disappeared, although such personal data has been processed in accordance with the provisions of the Personal Data Protection Law No 6698 and other relevant laws, and to request provision of information to third parties, to whom personal data has been disclosed, in relation with such deletion or disposal, to object to the occurrence of any negative results about data subject through analysis of the processed data exclusively by automatic systems, and to request indemnification of the loss suffered due to the processing of personal data in violation of the Law. Your request will be finalized as free of charge as soon as possible and no more than thirty days, depending upon the nature of the request. If you want to receive a written response to your application, no fee will be charged for up to ten pages, but a processing fee of 1 Turkish Lira will be charged for each page in excess of ten pages.
In accordance with the Article 8 of the Law No. 6563 on the Regulation of Electronic Commerce and the Article 9 of the Regulation on Commercial Communication and Commercial Electronic Messages, you can, at any time, opt out of receiving commercial electronic messages without specifying any reasons. You can opt out through the channel indicated in the commercial electronic message sent by us, or you can also exercise your opt-out right through the Message Management System (IYS). Sending of commercial electronic messages will be ceased within 3 (three) working days following the receipt by Mars Logistics of the opt-out notification.
